Terms of Service

These Terms of Service ("Terms") are entered into between you and Momentum Body Work LLC, a California limited liability company ("Momentum Body Work LLC"). Momentum Body Work LLC operates the MomentumWellness4you website and services. These Terms govern your access to and use of that website and platform (the "Service"). Please read them carefully.
Throughout these Terms, "MomentumWellness4you," "Momentum," "we," "our," and "us" refer to Momentum Body Work LLC. MomentumWellness4you is a brand name under which Momentum Body Work LLC operates; it is not a separate legal entity. Momentum Body Work LLC is the contracting party, the seller of any subscription, and the party responsible under these Terms.
Important: The Service is for education only. It is not medical advice and not a substitute for professional care. See Sections 7 and 8.
1. Acceptance of Terms
By creating an account, purchasing a subscription, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater), to create an account or purchase a subscription. By using the Service, you represent that you meet this requirement and that you are able to enter into a binding contract. The Service is intended only for adults and is not directed to children (see our Privacy Policy). If we learn that someone under this age has created an account, we may suspend or remove it.
3. Accounts
To access certain features, you must create an account using a valid email address and a password, managed through our authentication provider.
- You are responsible for providing accurate information and keeping it up to date.
- You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
- You agree to notify us promptly at founder@momentumwellness4you.com of any unauthorized use of your account or any other security concern.
- You may not share your account, sell access to it, or let others use it. Accounts are for a single individual.
We are not liable for any loss arising from unauthorized use of your account where you failed to safeguard your credentials.
4. User Responsibilities
When you use the Service, you agree to:
- Use it only for lawful, personal, educational purposes.
- Provide accurate account and billing information and keep your payment method current if you maintain a subscription.
- Comply with these Terms, our policies, and all applicable laws and regulations.
- Take responsibility for your own health decisions and, where appropriate, consult a qualified professional (see Section 8).
5. Acceptable Use
You agree that you will not:
- Copy, reproduce, distribute, publicly display, sell, rent, sublicense, or create derivative works from the Service or its content, except as expressly permitted by these Terms.
- Scrape, crawl, harvest, or use automated means to extract content or data from the Service, or otherwise access it other than through the interfaces we provide.
- Reverse engineer, decompile, or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law.
- Circumvent, disable, or interfere with security, authentication, paywall, or access-control features — including any attempt to access premium content without an active subscription.
- Upload or transmit malware, or attempt to gain unauthorized access to the Service, other accounts, or our systems or networks.
- Interfere with or disrupt the integrity or performance of the Service, or place an unreasonable load on our infrastructure.
- Use the Service to infringe others' intellectual property or other rights, or for any unlawful, fraudulent, or harmful purpose.
- Misrepresent the educational content as your own or as professional medical advice.
We may investigate and take appropriate action, including suspending or terminating accounts, for any violation of this Section.
6. Intellectual Property
The Service and all of its content — including the interactive 3D anatomy, medical illustrations, educational articles, text, graphics, software, design, and the selection and arrangement of all of it — are owned by Momentum or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Your license. Subject to these Terms and, where applicable, an active subscription, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service and its content for your own personal, non-commercial, educational use. This license does not transfer any ownership rights to you.
Reservation of rights. All rights not expressly granted are reserved by Momentum and its licensors. The "MomentumWellness4you" and "Momentum Body Work LLC" names, our logo, and our branding are our trademarks and may not be used without our prior written permission. Certain content may be provided under license from third parties and remains subject to their rights.
Your inputs. You retain any rights you have in information you submit to us, such as your account details and any messages you send us. You grant us a worldwide, royalty-free license to use that information solely to operate, secure, and improve the Service as described in our Privacy Policy. (Anatomy search runs in your browser; the terms you type are not submitted to us.)
Feedback. If you send us suggestions or feedback, you grant us the right to use it without restriction or obligation to you.
7. Educational Disclaimer
MomentumWellness4you is an educational anatomy platform. All content — including interactive 3D anatomy, illustrations, and articles — is provided for general educational and informational purposes only.
Educational content is prepared with care and is presented with review-status labels where applicable, but anatomy and clinical understanding evolve, and content may contain errors or omissions or may not reflect the most current information. Content is general in nature and is not tailored to any individual. You are responsible for how you use it.
8. No Medical Advice
Momentum is not a healthcare provider, and nothing on the Service is medical advice. The Service does not provide medical advice, diagnosis, treatment, physical therapy, telehealth, or emergency services, and no doctor–patient, therapist–client, or other professional relationship is created by your use of it.
- Always seek the advice of a qualified health professional with any questions about a medical condition, symptom, injury, or treatment. Never disregard or delay seeking professional advice because of something you read or saw on the Service.
- In a medical emergency, call your local emergency number (such as 911 in the United States) or go to the nearest emergency facility. Do not rely on the Service in an emergency.
- Do not use the Service to self-diagnose or self-treat.
You acknowledge and agree that your reliance on any content is at your own risk, and that Momentum is not responsible for decisions you make based on the Service.
9. Subscriptions and Billing
Parts of the Service are free (including the interactive 3D atlas). Premium educational content requires a paid subscription ("Membership").
- Plans and pricing. Membership is offered on a recurring basis (for example, monthly or annual) and may include a one-time onboarding fee charged at the start. The current plans, prices, billing intervals, and any applicable fees or taxes are shown at the point of purchase and on our membership page. Where we offer founding or promotional pricing, the terms of that pricing (including any commitment that it remains fixed while your Membership stays active) are described at purchase.
- Payment processor. Payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your selected payment method for the applicable fees. You agree to Stripe's terms in addition to these Terms, and you represent that you are authorized to use the payment method you provide.
- Taxes. Prices may be exclusive of taxes. You are responsible for any applicable sales, use, VAT, or similar taxes, which may be added at checkout.
- Price changes. We may change our prices. Any change to the recurring price of an existing Membership will not take effect until the next billing period and, where required by law, we will give you advance notice and the opportunity to cancel before the change applies.
10. Automatic Renewal
Your Membership renews automatically. Unless you cancel, your subscription will automatically renew at the end of each billing period (monthly or annual, as selected), and your payment method on file will be charged the then-current price for the next period, until you cancel.
You authorize these recurring charges. We (through Stripe) will continue to attempt to charge your payment method for renewals until the Membership is canceled or the charge is no longer possible.
11. Cancellation
You may cancel your Membership at any time through your account's billing management (the Stripe billing portal) or by contacting us at founder@momentumwellness4you.com.
- When you cancel, your Membership remains active until the end of the current paid billing period, and it will not renew after that. You retain premium access until the period ends.
- Cancellation stops future renewals; it does not, by itself, entitle you to a refund of amounts already paid (see Section 12).
- If a renewal payment fails, we may provide a short grace period during which access continues while payment is retried. If payment is not resolved, premium access will end.
12. Refund Policy
Because the Service provides digital educational content that is made available to you immediately, the following applies:
- Membership fees are billed in advance for each billing period and are generally non-refundable, except as required by applicable law or as expressly stated here.
- The one-time onboarding fee (if applicable) is non-refundable once your account has been granted premium access.
- You can cancel at any time to stop future charges (Section 11); we do not provide prorated refunds for the unused portion of a billing period unless required by law.
- Discretionary refunds. We may, at our sole discretion, offer a refund or credit in individual cases, such as a duplicate charge or a verified billing error.
- EEA/UK consumers. If you are a consumer in the EEA or the United Kingdom, you have a statutory right to withdraw from a purchase of digital content within 14 days. We honor that right: if you request withdrawal within 14 days of your purchase, we will refund you in accordance with applicable law.
To request a refund or report a billing problem, contact us at founder@momentumwellness4you.com. This Section is our Refund Policy; where we publish a separate Refund Policy page, it forms part of these Terms.
13. Termination
You may stop using the Service at any time and may request account deletion as described in our Privacy Policy.
We may suspend or terminate your access to the Service, in whole or in part, with or without notice, if:
- you breach these Terms or any applicable law;
- we reasonably believe your use poses a security, legal, or fraud risk; or
- we are required to do so by law, or we discontinue the Service.
If we terminate your account for a reason other than your breach, and you have prepaid for a Membership period, we will refund the unused, prepaid portion for that period. Upon termination, your license to use the Service ends immediately. Sections that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law — will survive.
14. Availability and Changes to the Service
We work to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. The Service may be unavailable from time to time due to maintenance, updates, provider outages, or events beyond our control.
We may modify, add, or discontinue features or content at any time, and we may impose limits on certain features or restrict access to parts of the Service without liability, subject to your rights under Sections 9–13 if a change materially affects a paid Membership.
15. Disclaimer of Warranties ("No Warranty")
The Service and all content are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Without limiting Sections 7 and 8, we make no warranty that the educational content is accurate, complete, current, or suitable for any particular purpose, and we make no warranty that the Service will be uninterrupted, secure, or free of errors or harmful components.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
16. Limitation of Liability
To the fullest extent permitted by law:
- Momentum, its owners, and its providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service.
- Momentum's total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the total amounts you paid to us for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD $100.
These limitations apply regardless of the legal theory on which a claim is based and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including, where applicable, liability for death or personal injury caused by negligence, fraud, or consumer rights that cannot be waived.
17. Indemnification
You agree to indemnify, defend, and hold harmless Momentum, Momentum Body Work LLC, and their respective owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms or applicable law; or (c) your violation of the rights of any third party. We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you will cooperate with us.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, and, where applicable, the federal laws of the United States, without regard to conflict-of-law principles.
Informal resolution first. Before filing any formal claim, you agree to contact us at founder@momentumwellness4you.com and attempt to resolve the dispute informally in good faith. Many concerns can be resolved this way.
Jurisdiction. Subject to any mandatory consumer-protection laws of your place of residence that give you the right to bring proceedings locally, you agree that the state and federal courts located in Sacramento County, California will have exclusive jurisdiction over any dispute not resolved informally, and you consent to their venue.
Nothing in this Section deprives a consumer of the protection of the mandatory laws of their country of residence.
19. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you by email or through the Service. Changes are effective when posted (or on a later date if we specify one). Your continued use of the Service after changes take effect means you accept the revised Terms. If you do not agree to the changes, you must stop using the Service and may cancel your Membership.

21. General
These Terms, together with the Privacy Policy and any policies referenced here, are the entire agreement between you and Momentum regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
